Welcome to Thizo. These terms govern your access to and use of Thizo's services. By accessing our platform, you agree to comply with these terms. If you do not agree, do not use our services.
1. User Responsibilities
You are responsible for ensuring that your actions on our platform comply with all applicable laws and regulations. Any content or materials you provide must not violate the rights of third parties. You agree not to misuse the platform, attempt to reverse-engineer any part of our technology, or use the platform for any unlawful purpose.
2. Account Security
You are responsible for maintaining the confidentiality of your account credentials. You may not share login access with individuals outside your firm. If you suspect unauthorized access to your account, notify us immediately at support@thizo.co. Thizo is not liable for losses resulting from unauthorized account access that you failed to report promptly.
3. Intellectual Property
Thizo retains all intellectual property rights in its platform, technology, processes, and proprietary software. This includes the AI systems, workflows, and tools used to produce deliverables.
Your firm retains full ownership of all materials you provide to Thizo, including drawings, specifications, project data, and any other client-supplied content. Thizo also assigns to your firm full ownership of all construction documents, BIM models, and other deliverables produced by Thizo on your behalf. Thizo claims no ownership over client deliverables.
You may not use, copy, modify, or distribute Thizo's platform technology or proprietary processes without prior written consent.
4. Acceptable Use
You agree to use Thizo's services only for lawful professional purposes consistent with architecture, engineering, and interior design practice. You may not use the platform to produce documents intended to deceive, defraud, or misrepresent project conditions. You may not attempt to extract, scrape, or systematically copy Thizo's underlying models or data.
5. Payment and Subscription Terms
Access to Thizo's services requires a valid subscription. Subscription fees are billed in advance on a monthly or annual basis as selected at signup. All fees are non-refundable except where required by law. Thizo reserves the right to suspend access if payment is not received within 10 days of the due date. 6. Service Modifications
Thizo reserves the right to modify, update, or discontinue any part of its services at any time. We will provide reasonable advance notice of significant changes that affect your workflow or deliverable standards. Continued use of the platform after such notice constitutes acceptance of the changes.
7. Limitation of Liability
Thizo will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to lost revenue, lost data, or project delays. Our total liability to you for any claim arising under these terms will not exceed the fees you paid to Thizo in the three months preceding the claim.
Thizo is a technology platform. We do not practice architecture, engineering, or interior design. We are not responsible for the interpretation of local building codes, zoning regulations, accessibility standards, or other jurisdiction-specific requirements. Your licensed design professionals retain responsibility for reviewing, approving, and signing all construction documents produced with Thizo's assistance.
8. Indemnification
You agree to indemnify and hold harmless Thizo, its officers, employees, and contractors from any claims, damages, or expenses — including reasonable attorneys' fees — arising from your use of the platform, your violation of these terms, or your infringement of any third-party rights.
9. Warranty Disclaimer
Thizo's services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the platform will be error-free, uninterrupted, or free of security vulnerabilities. No output produced by Thizo should be used in construction without review and approval by a licensed design professional.
10. Governing Law
These terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the state and federal courts located in New York.
11. Changes to These Terms
We may update these terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and notify active users by email where required. Your continued use of Thizo's services after changes are posted constitutes your acceptance of the revised terms.
